TERMS OF SERVICE

These Terms of Service (“Terms”) govern your access to and use of RTCDirectMarketing.com (the “Site”) and any related content, forms, communications, services, and deliverables provided by RTC Direct Marketing (“RTC,” “we,” “us,” or “our”). By accessing or using the Site, submitting any form, booking an appointment, subscribing to email or SMS messaging, or otherwise engaging with RTC, you agree to be bound by these Terms.

2) Scope of Services & No Guarantee

RTC provides digital marketing and technology-related services including (but not limited to) lead generation, paid advertising management, website/landing page development, UI/UX, graphic design, email and SMS campaigns, CRM configuration, automation/integration services, analytics, project management, and data solutions.

Results from marketing and technology services can vary substantially based on market conditions, competition, ad budgets, creative quality, website performance, sales follow-up, compliance, and external platform policies. RTC does not guarantee specific results (including leads, sales, rankings, ROAS, revenue, or profit) unless expressly agreed to in a signed written contract with defined performance metrics.


3) Website Use & Acceptable Conduct

A. Permitted Use

You may use the Site for lawful business purposes, to request information, and to engage RTC services.

B. Prohibited Use

You agree you will not:

  • Use the Site for unlawful, fraudulent, misleading, or harmful purposes
  • Attempt to gain unauthorized access to systems, accounts, or data
  • Introduce malware, scraping tools, bots, or disruptive code
  • Interfere with the Site’s operation, security, or performance
  • Submit false information or impersonate another person or entity

4) Forms, Submissions & Communication Consent

When you submit any form on RTCDirectMarketing.com (including contact forms, appointment/consultation forms, quote forms, newsletter forms, and Go-Mobile SMS registration forms), you represent that the information you provide is accurate and that you are authorized to provide it.

By submitting a form, you may be contacted by RTC via email, phone, and/or SMS depending on the information you provide and the communication options you select or consent to (see SMS Terms in Section 5).


5) SMS / TEXT MESSAGING TERMS (Opt-In, Marketing, and Third-Party Offers)

A. Opt-In & Types of Messages

If you provide your mobile number and opt in (e.g., by checking a consent checkbox or otherwise agreeing to receive SMS), you consent to receive text messages from RTC Direct Marketing. Messages may include:

  • Account/Service Info: responses to inquiries, account updates, service communications
  • Appointments: confirmations, reminders, reschedules, follow-ups
  • Project Updates: milestones, approvals, delivery notifications, time-sensitive requests
  • Marketing Messages: promotions, new services, announcements, and offers
  • Third-Party / Partner Offers: where permitted by law, promotional content from partners that may be relevant to business or marketing services

Consent is not a condition of purchase. Message and data rates may apply. Message frequency may vary.

B. How to Opt Out & Get Help

You can opt out at any time by replying STOP to any text message. After texting STOP, you may receive a final confirmation message. For help, reply HELP or contact us at info@rtcdirectmarketing.com.

C. Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery may be affected by device compatibility, your mobile carrier, coverage area, and other factors outside of RTC’s control.

D. Message Content & Compliance

SMS content may be informational, transactional, or promotional. You agree that message content and timing may vary based on your interactions, appointments, and marketing preferences. If a separate SMS disclosure exists on a specific form/page, that disclosure is incorporated into these Terms by reference.


6) Billing, Payments, and Refunds

If you purchase services from RTC, pricing, payment schedule, deliverables, timelines, and refund/termination terms will be outlined in a written proposal, scope of work, or service agreement. Unless otherwise stated in writing:

  • Fees are due according to the agreed invoice schedule
  • Past due invoices may result in paused work or suspension of services
  • Third-party costs (ad spend, software tools, hosting, domains, SMS fees, etc.) are typically billed separately

Any refunds, if applicable, are governed by the signed agreement and/or the specific invoice terms.


7) Third-Party Platforms, Tools, and Links

The Site may reference or link to third-party websites, tools, platforms, plugins, CRMs, advertising networks, and services. These third parties maintain their own terms and privacy policies, and RTC is not responsible for their content, availability, or practices.

Marketing platforms (e.g., Google, Meta, Microsoft, TikTok, LinkedIn) may change policies, approvals, tracking methods, and performance dynamics. RTC is not responsible for platform outages, policy changes, account suspensions, or ad disapprovals caused by factors outside RTC’s control.


8) Intellectual Property

A. Site Content

All Site content, branding, design elements, and materials are owned by RTC or licensed to RTC and are protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from the Site without written permission.

B. Client Deliverables

Ownership and licensing of deliverables (e.g., designs, code, creative assets, ad accounts, landing pages) will be defined in your service agreement. Unless otherwise stated, RTC may use non-confidential work samples for portfolio/marketing purposes.


9) Disclaimers

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

RTC DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED IMMEDIATELY.


10) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RTC’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID RTC FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT.


11) Indemnification

You agree to defend, indemnify, and hold harmless RTC and its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising from or related to: (a) your use of the Site; (b) your violation of these Terms; (c) your content, ads, products, services, or business practices; or (d) your violation of any law or third-party rights.


12) Termination

RTC may suspend or terminate access to the Site or services at any time if we believe you have violated these Terms, created risk for RTC, or engaged in unlawful activity. You may stop using the Site at any time. Service termination terms (including access to deliverables, accounts, and refunds) are governed by your written agreement with RTC.


13) Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised Effective Date. Your continued use of the Site after changes are posted constitutes your acceptance of the updated Terms.


14) Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict of law principles. You agree that any dispute arising from these Terms will be resolved in the appropriate state or federal courts located in Wyoming, unless otherwise required by applicable law.
